A district judge issued a bench warrant Tuesday for a Mifflin County man who failed to attend his preliminary hearing on indecent assault charges and other offenses.
Chad Atherton, 39, of McVeytown, is accused of having indecent contact with a 17-year-old girl and her mother while visiting them at their Cromwell Township home overnight Nov. 27-28.
Magisterial District Judge Lisa Covert issued a bench warrant for Atherton when he didn’t show for his hearing, which was scheduled for 10 a.m. Tuesday via Zoom.
According to the affidavit of probable cause filed by state police at Huntingdon, Atherton provided the 17-year-old and her 14-year-old sister with alcohol, then inappropriately touched the 17-year-old and suggested she have sex with him.
The 17-year-old told police she called her boyfriend’s mother for a ride and as she left the home with her sister, she saw Atherton laying on top of their mother who was passed out.
Police say the 17-year-old, who reported the incident Nov. 28, described Atherton as a longtime friend of the family.
When police spoke with Shawn Kurey, boyfriend of the girls’ mother, Kurey told them Atherton just showed up at their house on Chester Furnace Road and that he and Atherton drank a few beers. Kurey said he passed out after those few drinks and awoke five hours later, noting this was unusual.
Police say the adult victim confirmed that Kurey did pass out and after she had a few shots with Atherton, she wasn’t feeling right and laid down. She told police she vaguely remembers somebody kissing her but couldn’t say who.
Police say when they questioned Atherton, he said he didn’t recall much of what happened, saying he’d consumed four or five of shots and a couple of beers, then blacked out.
Atherton is charged with misdemeanor 1 indecent assault on an unconscious person; misdemeanor 2 indecent assault without consent; two counts of misdemeanor 3 furnishing alcohol to minors; and two counts of summary harassment.
